My terms of service

commissioning me means you agree with my terms below, which may change at any time. I can cancel a slot at any time if my terms are not respected.

general

- payment via paypal invoice only
- 100% payment upfront
- if invoice is not paid within 2 days, your commission might be cancelled
- I do not do waitlists or holds
- non-negotiable 4% tax + $0.49 fee added to ALL orders to cover paypal fees, under the name “artist fee” and “artist tax”
- I reserve right to post the commissioned artwork anywhere at any time on social media, unless requested otherwise
- I reserve the right to recycle poses and wips that went unused due to being scrapped or cancelled
- I require a clear, unshaded reference to work off of. If you request that I add anything to the design that is not clearly shown in the reference image, I may require a small fee.
- failure to read or abide by my TOS is not my responsibility, and any disagreements are the fault of the client.
- I DO NOT PROVIDE REFUNDS.

client rights

- Client can request their commission be kept private, and I will not upload it to any of my galleries (please do so asap!)
- Client may ask to remain anonymous when I upload art
- Client may upload the art anywhere they choose, with credit given to me
- Client may use the artwork for any and all personal means (wallpaper, print, social media icon, ref sheet, etc)
- Client may use character design for any and all personal means (roleplay, drawing, fanfiction, commissioning others, etc)
- Client MUST credit me as the creator of the commissioned design when uploading to toyhouse
- I must always be credited as the creator of the commissioned design, regardless of any modifications, redesigns, etc
- Client may resize, crop, add a background to transparent files, add text, and other similar edits that do not alter the artwork
- Client may make small edits to a character design, so long as I am notified and it abides by any closed-species rules when applicable
- Client may NOT alter the artwork itself without my permission
- Client may NOT use the artwork or character design for commercial use whatsoever
- None of my artwork may be used in ANY blockchain-related technology, including NFTs, cryptocurrency, or any past, present, or future blockchain-associated technologies.
- Any requests such as the way I interpret the character design/species/anatomy, pose, expression, etc, that are not made upfront will not be honored.
- Client may not sell commissioned design for a price that is higher than what it was purchased for. It is preferred that you negotiate the terms of reselling with me, so things go smoothly :)

payment and process

- Due to past experiences I always require 100% payment upfront. this is non-negotiable
-Payment must be fully processed before I will send any WIPS
- payment must be recieved via paypal invoice
- I will never accept payment via any digital or alternative currency, such as gift cards, cryptocurrency, or deviantart points, unless specified
- I reserve the right to apply any taxes I deem necessary. Client will always receive full transparency of what taxes are applied and why, which can be viewed in the details of the commission invoice.
- I reserve the right to apply any fees I deem necessary. Client will always receive full transparency if what fees are applied and why, and added fees will never exceed 50% of the listed price, unless agreed upon by the client.
- I will send a rough sketch in the beginning for approval, at this stage any requested changes will be done for free.
- I will continue to send WIP shots at each stage in the process (lines, colors, etc)
- Additional changes like pose, expression, anatomy, details, etc, after line work has started may be subject to a small fee.
- Redlining my sketch is always okay to help get your point across!

What fees might be applied?

(please note that I only included the most general fees, other fees not listed may be applied, but this will ALWAYS be communicated to the client. Additionally, fees may be under or exceed the listed amount.)
- $5-$10 complexity fee for designs that are detail heavy and/or have complex patterns
- $5-$10 fee may be applied to characters that have detailed apparel (several pieces of detailed jewelry, detailed satchels or bags, detailed clothing, and other detailed accessories)
- $10 minimum fee applied to all weapons. An extra $5 may be applied if alts (with and without weapon) are desired.
- $15 minimum fee applied to all armor (this applies to partial suits of armor, fees for full suits of armor will be negotiated case by case)
- $10 minimum fee for gore or body horror that differs from what is shown in the reference image (for example, if you requested that I draw a character with 6 wings but their reference image only includes 2.)
- 50% fee applied if any additional characters are added

turnaround time

- Depending on commission complexity, my current queue, personal situation, etc, finishing one piece may vary from a few days to a couple weeks.
- I work on pieces one at a time in the order they appear on my trello.
- depending on where your spot in my queue is, it may take longer to start your commission.
- I suffer from untreated depression and ADHD, and I also have autism, so my ability to work is highly susceptible to my mental health :( I know that on a professional level this is not desirable, but with that in mind, I guarantee that regardless of how much time it takes I will ALWAYS complete your commission and provide a high quality product.
